Representative Cases
Steven Murray has successfully represented clients in jury trials and litigation before United States District Courts and before agencies of the United States Government. Set forth below are examples of cases.
- Jury Trial. Age Discrimination – Discharge. Representation of prevailing former employee of Defendant, an insurance company, in jury trial before the U.S. District Court for the District of Colorado. The jury ruled in favor of female Plaintiff, finding the Defendant committed willful Age Discrimination in discharging the Plaintiff. The jury awarded the Plaintiff damages and parties resolved issues of damages, liquidated damages, front pay, attorney fees, and costs.
- Sex Discrimination – Harassment – Retaliation. Representation of female employee of Defendant, the U.S. Department of Interior, before the U.S. District Court for the District of Colorado−action favorably resolved through settlement.
- Jury Trial. Retaliation. Representation of prevailing employee of Defendant, the U.S. Department of Veterans Affairs, in jury trial before the U.S. District Court for the District of Colorado. The employee prevailed on claim of EEO retaliation. The jury found Defendant liable for intentional retaliation and awarded compensatory damages. The Court awarded attorney fees and costs.
- Racial Discrimination – Harassment. Co-counsel for the U.S. Equal Employment Opportunity Commission [EEOC], before the United States District Court for the Middle District of Alabama., Northern Division. The EEOC alleged a private sector employer subjected a class of seven African-American men to a racially hostile environment, including a noose at the worksite, vile racial language, and references to the Ku Klux Klan. The case was resolved through settlement providing $400,000 to class members and nonmonetary relief.
- Race Discrimination – Harassment. Representation of Plaintiff, an African American male, alleging racial harassment and a racially discriminatory discharge against Defendant, a private sector entity, before the U.S. District Court for the District of Colorado. Case resolved through settlement, following a favorable Court ruling for Plaintiff on Defendant’s motion for summary judgment.
- Jury Trial. Race/National Origin Discrimination. Representation of prevailing Plaintiff, a former employee, subjected to discharge by Defendant, a private company, in jury trial before the U.S. District Court for the District of Colorado. The jury ruled in favor of the Plaintiff, finding the Defendant committed intentional discrimination, and awarded damages. Post-trial issues resolved by parties.
- Disability Discrimination. Failure to Provide Reasonable Accommodation. Co-counsel for the U.S. Equal Employment Opportunity Commission [EEOC], before the United States District Court for the Northern District of Florida. The EEOC alleged the Defendant refused to provide employee with a reasonable accommodation and subsequently discharged the employee after she requested an accommodation. The case was resolved through settlement providing $125,000 to the employee and nonmonetary relief.
- Jury Trial. Age Discrimination – Failure to Hire. Representation of prevailing Plaintiff, a non-selected applicant for employment with the City and County of Denver [Fire Department], in jury trial before the U.S. District Court for the District of Colorado. The jury ruled in favor of the Plaintiff, finding the City had engaged in willful Age Discrimination, in the non-selection of the Plaintiff for employment. The jury awarded damages, the Court awarded liquidated damages, and the Defendant paid Plaintiff’s damages, liquidated damages, front pay, attorney fees, and costs.
- Jury Trial. Retaliation – Discharge. Representation of prevailing Plaintiff, a male and former employee of a private company, in jury trial before the U.S. District Court for the District of Colorado. The jury ruled in favor of the employee, finding the Defendant committed willful Retaliation in violation of the Age Discrimination in Employment Act, in discharging Plaintiff. The jury awarded damages to Plaintiff and the Court awarded liquidated damages, front pay, attorney fees, and costs.
- Sex Discrimination – Harassment & Hostile Work Environment – Retaliation. Representation of Plaintiff, a prior female employee of Defendant, the Office of the District Attorney, 13th Judicial District of Colorado, before the U.S. District Court for District of Colorado. Following favorable Court ruling for Plaintiff on Defendant’s motion for summary judgment, the action was resolved through settlement.
- Sex Discrimination – Hostile Work Environment – Retaliation. Representation of Plaintiff, a female employee of the Colorado Department of Transportation before the U.S. District Court for the District of Colorado. Favorable resolution of case through settlement on the first day of the trial.
- Sex Discrimination – Retaliation – Section 1983: First Amendment Claim. Favorable settlement on behalf of female employee of Defendant, an employee of the City and County of Denver [Police Department], before the U.S. District Court of Colorado. Case resolved following favorable summary judgment ruling on gender discrimination and retaliation claims, and claim for violation of First Amendment right of association based on municipal policy & custom.
- Federal Agency Hearing – Discharge for Misconduct. Representation of a prevailing federal government employee before the U.S. Foreign Service Grievance Board. The Government Agency employer sought to discharge the employee for misconduct. The Board ruled in favor of the employee. The employee retained his employment position and he was awarded attorney fees and costs.
- Federal Agency Hearing – Discharge for Misconduct. Representation of prevailing federal government employee before an Administrative Judge of the U.S. Merit Systems Protection Board [MSPB], Denver Field Office. The Agency employer, a branch of the United States military, discharged the civilian employee based on misconduct. The Administrative Judge ruled in favor of the employee, reversing the discharge and ordering reinstatement. The Agency employer paid the employee’s attorney fees and costs.
- Federal Agency Hearing – Performance-Based Discharge. Representation of prevailing federal government employee of the U.S. Department of Interior before an Administrative Judge of the U.S. Merit Systems Protection Board [MSPB]. Denver Field Office. The Agency employer discharged the employee based on performance. The Administrative Judge ruled in favor of the employee, reversing the discharge and ordering reinstatement. The Agency employer paid the employee’s attorney fees and costs.
